Encore CONTRACT

THIS CONTRACT for the personal services of independent contractor musicians on the engagement described

and the undersigned Signatory Musician.

6. No performance on the engagement shall be recorded, reproduced or transmitted from the place of performance in any manner or by any means whatsoever, in the absence of a specific written agreement with the Signatory Musician relating to and permitting such recording, reproduction or transmission. The Signatory Musician may enforce this prohibition in any court of competent jurisdiction.

7. Instruments must be protected from sun, heat, moisture, hot and cold temperature.

8. Musicians will be given a ten minute break after each 60 minutes of playing.

9. This contract and the terms and conditions contained herein may be enforced by the Purchaser and its agents, and by each Musician who is a party to this Contract or whose name appears on the Contract, or who has, in fact, performed the engagement contracted for.

10. A deposit of one-half of the total Compensation Agreed Upon for performing will be paid by the Purchaser at the time this Contract is signed and returned to the undersigned Signatory Musician. Checks should be made payable to SUSAN R. SMITH
